Is the $549 truly all-in?+
Yes. $549 covers our attorney-reviewed preparation and filing plus the $350 USPTO government fee for one federal class. There is no separate 'legal fee' or 'processing fee' added at checkout — additional classes are only if you choose to protect the mark in a second or third class.
What if my mark isn't clearable?+
If our clearance search returns a serious conflict that would almost certainly get your application refused, we tell you before filing and refund the government fee portion. You never pay the USPTO for a filing we don't recommend.
Do I need to be a U.S. citizen?+
No. The USPTO accepts applications from anyone in the world. Foreign applicants are required to be represented by a U.S. licensed attorney — which is exactly what's included in the $549.
How long until I can use ®?+
The ® symbol can only be used once the mark is federally registered — typically 12 to 18 months after filing. Until then, TM (for goods) or SM (for services) can be used the moment you file.
What is a 'class' and can I add more?+
The USPTO groups goods and services into 45 classes. Your $549 covers one class. Additional classes are optional and can be added at checkout — each additional class carries its own $350 USPTO fee at cost.
What happens if the USPTO issues an Office Action?+
Routine (non-substantive) office actions — clarifying a specimen, tightening the description of goods — are handled for you at no extra cost. Substantive refusals (likelihood of confusion, descriptiveness) are quoted separately and only proceed with your written go-ahead.
